While every case is different, here is a general overview of how most personal injury cases work. Step 1: Initial Consultation And Investigation
Your case will begin with your free initial consultation with an attorney, where we will gather some preliminary information and evaluate whether your case is worth pursuing. If we decide to work together, we will continue to learn more about the situation, gathering evidence and determining who can be held responsible for your injury. Where appropriate, we will interview witnesses; evaluate reports, photos and other evidence; and consult specialists to analyze the situation that caused your injury
At this stage, we will also determine the full impact of your injury to you and your family so we can help you seek compensation that covers your medical needs as well as your pain and suffering.
Step 2: Demand Settlement
Once we have determined who can be held responsible for your accident and the compensation we should seek, we will draft a demand letter for a settlement. In the case of motor vehicle accidents, we typically seek settlements from an insurance company, not the at-fault driver. We may need to negotiate before we can reach an agreement on an appropriate settlement.
Step 3 (If Necessary): File A Lawsuit
If we cannot reach an acceptable settlement, the next step is often to file a lawsuit. In some cases, your case will go to mediation in a final attempt to reach a settlement outside of trial. If your case goes to trial, a judge or jury will ultimately determine the damages you are entitled to receive.
